The short version
- Search results come from public trademark registries, and every result shows its source.
- Trademarking prepares filings. You file them in your own name, as the owner of the mark.
- Where an office requires a local representative, the filing goes through a partner attorney or lawyer that you engage.
- Likelihood and similarity scores are estimates, not legal advice. Trademarking is not a law firm.
- Official fees are paid by you directly to the trademark office. They are not part of your subscription.
- Plans are subscriptions that renew until you cancel. Payments are final, as set out in the refund policy.
1. Who we are and who these terms apply to
The trademarking.ai service ("Trademarking", "the service") is operated by the administrator of the trademarking.ai service ("we", "us"). You can contact us at [email protected]. These terms apply to everyone who creates an account or uses the service. If you use the service for a company, you confirm that you may bind that company, and "you" means the company.
2. Your account
You need an account to use most of the service. Keep your sign-in details secure and tell us at once if you suspect someone else has access. You are responsible for what happens in your workspace, including the actions of team members you invite. You must be at least 18 years old to create an account.
3. Registry data and sources
Search results, watch alerts and portfolio records are built from data published by trademark offices in their public registries. Every result shows the office, the record number and, where the office provides one, a link to the official record. Offices update their registries on their own schedules, so a very recent filing may not appear yet, and an office can correct or withdraw a record after we have shown it. The official registry is always the authoritative source.
4. Scores are estimates, not legal advice
The registration likelihood and the similarity percent are estimates calculated from public registry data: identical and similar marks, phonetic and visual similarity, class overlap and record status. They cannot take into account unregistered rights from use of a mark, the discretion of an examiner, the strategy of another owner or facts you have not entered. A high likelihood is not a guarantee of registration, and a low one is not a finding that a mark cannot be registered.
Trademarking is not a law firm and does not provide legal advice. Nothing in the service creates an attorney and client relationship between you and us. If you need a legal opinion, consult a qualified attorney or lawyer.
5. Filing preparations and who files
A filing preparation is a package of information and documents for one mark in one filing route: owner details, the mark, the Nice classes, goods and services wording, a specimen checklist and the steps of the chosen office. We prepare it from the information you give us. You review it and you file it in your own name, as the applicant and owner of the mark. We do not file applications on your behalf and we do not become the owner or applicant of any mark.
Some offices require applicants from other countries to act through a local representative, and some later steps, such as responses to an office action or an opposition, may require one. In those cases the filing or the step goes through a partner attorney or lawyer whom you engage directly. That professional works for you under their own terms and fees, which are separate from your subscription.
You are responsible for the accuracy of the information in your application, for the decision to file and for meeting the deadlines of the office. Our reminders and deadline calculations help you, but the deadline set by the office is the one that counts.
6. Official fees
Trademark offices charge official fees for applications, classes, renewals, oppositions and other steps. These fees are not included in any plan. You pay them directly to the office, or through the representative you engage. The fees we show are estimates based on the schedules the offices publish, with the office as the source; the office decides the final amount.
7. Plans, billing and renewals
The service is sold as a subscription with the monthly or yearly price and the limits shown on the pricing page at the time you subscribe. A subscription renews automatically at the end of each period until you cancel it. Limits renew with each billing period and count usage in the period, so deleting a search, a watch or a filing preparation does not restore the limit.
When you move to a higher plan or from monthly to yearly billing, the difference is charged immediately and the new plan starts once that payment succeeds. Moving to a lower plan takes effect at the next renewal. You can cancel at any time in Billing in your workspace; cancelling stops the next renewal and the plan stays active to the end of the paid period. Refunds are governed by the refund policy. Prices exclude any tax that applies in your country, which is added at checkout where required.
8. Acceptable use
You agree not to use the service to break the law or the rights of others, to file marks in bad faith or to obtain rights in a mark that belongs to someone else, to resell raw registry data or bulk export it outside the features and API limits of your plan, to share one account between several people outside the seats of your plan, to probe, overload or bypass the security or the limits of the service, or to access it with automated tools except through the API.
9. Your content
You keep all rights in the content you enter or upload. You give us a limited licence to store and process it only to provide the service to you. We do not use the names you search for any purpose other than your own work in the service.
10. Agency plan and client work
If you use the Agency plan for clients, you are responsible for your relationship with each client, including any authority you need to handle their data, and for the advice you give them. White label reports carry your branding; you may not present them as issued by a trademark office.
11. API
API access is part of the Agency plan, within the monthly call limit of the plan. Keep your API keys secret. We may suspend a key that is used in breach of these terms or that endangers the service.
12. Availability and changes to the service
We work to keep the service available around the clock, but we do not promise uninterrupted operation. Offices sometimes change or interrupt their data, which can delay results or alerts. We may improve and change features; we will not remove a core feature of a plan you have paid for during the paid period.
13. Liability
The service is provided as described on our website. To the extent the law allows, we are not liable for indirect or consequential losses, lost profits, a refused or opposed application, or decisions you make based on an estimate. Our total liability for any claim connected with the service is limited to the amount you paid us in the 12 months before the claim. Nothing in these terms limits liability that cannot be limited by law, or the statutory rights of consumers.
14. Suspension and termination
You can delete your account at any time in your profile settings. We may suspend or close an account that breaches these terms, that is used for fraud, or whose payment is reversed through a chargeback without first contacting us. Before deletion you can export your portfolio and reports.
15. Changes to these terms
We may update these terms. When a change matters for you, we tell account owners by email before it takes effect. If you do not accept the change, you can cancel before the next renewal.
16. Governing law
These terms are governed by the law that applies to the administrator of the service, without depriving consumers of the protection of the mandatory rules of the country where they live. Disputes go to the competent court under that law, and consumers may also use the courts of their own country.
