Trademarking disclaimer and what the service does not do

Short answer

Trademarking disclaimer in short: we are software, not a law firm. Scores are estimates from public registry data, you file in your own name, official fees go to the office and registration is never guaranteed.

  • Trademarking is not a law firm and does not create an attorney client relationship.
  • Scores and likelihoods are estimates based on public registry data.
  • The office and third parties decide whether a mark registers.

Software, not legal advice

Trademarking is a software service. Using it does not create an attorney client relationship, and nothing on the site or in a report is legal advice. Where an office requires representation, a partner attorney files for you; that attorney is independent and responsible for their own work.

What scores and search results mean

  • Registration likelihood and similarity scores are estimates, not predictions of an office decision.
  • Results come from public registry data from offices such as the USPTO, EUIPO, WIPO, UKIPO and UPRP, with the source shown.
  • Registries can lag behind new filings, so a recent application may not appear yet.
  • A clearance search reduces risk; it does not remove it.

Filing and fees

You file the trademark registration in your own name and own the result. Official fees are paid by you directly to the office and are separate from your plan. No outcome is guaranteed: the examiner and any opponent decide whether a mark registers.

Frequently asked questions

Who is responsible for the filing?
You are, as the applicant. Where a partner attorney files for you, that attorney is independent.
Can a high score still be refused?
Yes. Scores are estimates and the office can raise objections the data does not show.
