EU trademark check and EUIPO filing for all member states

Short answer

An EU trademark check searches EUIPO records for similar earlier marks before you file one application that covers all 27 member states. The EUIPO fee is 850 EUR for one class online as of 2026, and applicants outside the EEA need a representative.

From filing to registration at EUIPO

  1. 1

    Filing

Online application; the basic fee covers one class.

  2. 2

    Examination

The EUIPO checks absolute grounds only, such as descriptiveness, not conflicts with earlier marks.

  3. 3

    Publication

The application is published and earlier right owners have 3 months to oppose.

  4. 4

    Registration

Without opposition, registration typically follows about 4 to 6 months after filing.

Rules worth knowing before you file

  • Because the EUIPO does not refuse marks for conflicting with earlier rights on its own, owners must watch and oppose. That makes trademark monitoring important in the EU.
  • An EU trade mark is unitary: a successful opposition based on a national right in one member state can block the whole application.
  • The EU trade mark does not cover the United Kingdom; file there separately.

How Trademarking handles a EUIPO filing

  1. Step 1

We search EUIPO records and the other offices you choose for identical and similar marks, and show a registration likelihood with the closest conflicts and their source.

  2. Step 2

We map what you sell to Nice classes and suggest wording from the office lists, which keeps you clear of surcharges and objections. See the class guide.

  3. Step 3

We prepare the EUIPO application: applicant details, mark type, classes and the goods and services text.

  4. Step 4

Applicants without domicile or establishment in the EEA must be represented by an EEA professional representative. In that case the filing goes through a partner attorney admitted before EUIPO, and you still own the application.

  5. Step 5

After filing, deadlines, office actions, publication and the opposition window appear in your portfolio, and trademark monitoring alerts you to similar new filings.
