The best trademark filing service depends on what you still need after the application is submitted. LegalZoom, Trademark Engine and Trademarkia suit owners who want someone else to file. A law firm suits a disputed or high value mark. Trademarking suits owners who prefer to file in their own name and want search, deadlines and a watch on one plan.

This guide is for US small business owners choosing how to file a federal application. Trademarking is our product and is not a law firm. Fees, packages and terms change often, so treat every provider detail below as something to confirm on the provider's site before you pay.

What does a trademark filing service actually do?

A filing service takes your mark, goods and services and owner details, runs a search, formats the application and submits it to the USPTO. It does not decide whether the examiner approves the mark, and no service can guarantee registration. The government fee goes to the USPTO whichever route you choose.

What differs is everything around the form. Some services include a legal review of your goods description, some answer the first office action, and some stop the day the application is submitted. Ask three questions before you pay. Who reads the description of goods? What happens if the examiner objects? Who tells you when someone files a similar mark later?

Is a trademark filing service worth it?

It is worth it when a mistake would cost more than the fee. A wrong description of goods or an unnoticed conflicting mark can sink an application after a year of waiting, and the USPTO fee is not refunded when an application is refused. For a single clean word mark in an uncrowded field, filing yourself is possible, but most owners value the second pair of eyes on the description.

It is not worth paying twice for the same thing. If a package includes a watch for twelve months and you later buy a separate watch plan, check whether you now pay for overlapping coverage. The trademark watch service cost breakdown shows typical per mark prices so you can compare.

How much does it cost to file a trademark with a service?

The USPTO base application fee is 350 USD per class as of 2025, and extra surcharges apply when you write free form goods descriptions instead of using the office manual wording. A service fee comes on top and varies widely, from a modest per filing package to a professional fee at a firm. See the trademark registration cost guide for the full stack, including declaration of use and renewal fees years later.

Work out a three year figure, not the first checkout total. Add the filing package, the USPTO fee per class, any office action response fee, and a watch for the period you expect to need it. A cheap filing with a paid response and a separate watch can cost more than a plan that bundles all three.

Which filing service is best for a small business?

If you want it filed for you with minimal effort

A guided service with attorney review fits. LegalZoom, Trademark Engine and Trademarkia all sit here, and they differ mostly in package structure and what happens after submission. Read the exact scope of the office action response before you buy, because that is where most surprise fees appear. Our LegalZoom alternative, Trademark Engine alternative and Trademarkia alternative pages set out the differences in detail.

If the mark is valuable or contested

Hire an independent trademark attorney. A registered mark also counts when a buyer prices your company, so owners planning a sale often decide how much to spend after they estimate what the business is worth. An attorney can read a clearance search, argue a refusal and advise on a coexistence agreement, which no form based service does.

If you want control and ongoing protection

Run the search first, prepare the application in your own name and set up a watch. Trademarking does this on a flat plan: a name availability search across registries, a prepared filing pack, a daily registry watch and a calendar for the declaration of use and renewal. Where an office requires a representative, a partner attorney files for you. See the plans to match your number of marks.

Is LegalZoom good for trademarks?

LegalZoom is a reasonable choice for an owner who wants a recognizable provider and a guided form. The usual criticism is cost growth once add ons are included, and a watch that is sold separately. Our LegalZoom trademark monitoring review covers the watch product and its yearly price.

Is Trademark Engine legit?

Trademark Engine is a real online filing service that files applications with the USPTO. Judge it on scope, not legitimacy: confirm what is included in the package, whether an attorney reviews the application, and what an office action response costs.

A three year cost example for one class

Take a food brand filing one word mark in one class. Every route pays the same 350 USD USPTO fee. After that the numbers diverge. A form based package adds its filing fee, and an office action response may be extra. An attorney adds a professional fee for the search, the filing and any response. Filing yourself adds nothing, but a missed objection costs you the application and the fee with it.

Now add the years after filing. A watch for three years at the 175 USD a year LegalZoom lists comes to 525 USD. On Trademarking Founder at 588 USD a year, the same period costs 1,764 USD, but that includes unlimited searches, the filing pack and deadline tracking for the Section 8 window, not only the watch. Put your own provider quotes into the same layout and compare totals, not checkout prices. The Trademarking trademark search shows who already holds a close mark before you spend any of it.

What should you check before choosing a trademark filing service?

  • Search first. A filing without a clearance search is a gamble. Run a trademark clearance search on the name, close spellings and similar sounds before paying any filing fee.
  • Owner name. The application must be in the name of the person or entity that controls the brand. A wrong owner can void the registration.
  • Goods and services wording. Prefer the office manual descriptions. Free form wording triggers a surcharge and can narrow your protection.
  • Office action cover. Ask whether the response is included, how long you get to respond and who signs it.
  • After filing. Ask what happens in years one to ten. The declaration of use falls between years 5 and 6, and renewal at year 10.
